BUYERS shall purchase and BREEDER shall sell the above described dog in consideration of $_______________ cash in hand or bank check subject to the following conditions of sale.
This dog is being sold as a companion and family member. This puppy is a purebred Border Terrier, is registered with the American Kennel Club, and at the time of sale is free of any major disqualifying fault named in the Border Terrier Breed Standard of the American Kennel Club.
How you raise your dog, what you feed your dog, how much attention and exercise you allow, and what kind of protection you provide against distemper, hepatitis, leptospirosis, parvo, corona, kennel cough, rabies and heartworm is your future responsibility. Your sincere approach to do the right thing for your dog is, in reality, a protection of your investment and helps secure a long and happy life for a devoted companion.
BREEDER and BUYERS agree that the above described dog is being sold as a companion/pet/family dog only and, therefore, is to be spay/neutered by _____________, at which time the puppy will be ______ year old, however neutering can occur at any time after the age of ____ months. The cost of the spay/neutering will be the sole responsibility of the BUYERS. When proof of neutering has been sent to the BREEDER, the signed registration will be given to the BUYERS for transfer into their sole ownership.
BREEDER warrants that on the date of this contract, the dog appears to be free from any communicable diseases, is in apparent good health, and is free from apparent wounds or injuries. BREEDER will furnish BUYERS with a copy of full immunization record. The BUYERS agrees to take the puppy to a licensed veterinarian within 7 days of purchase. Should the examining veterinarian find that the dog is ill or unsound, said findings must be certified in writing, the BUYERS may elect to immediately return the dog to the BREEDER for full refund of purchase price.
BUYERS shall assume full responsibility for the health of the dog following said 7 day period. BUYERS further agrees to maintain the dog at all times in good health with periodic check-ups, heartworm preventatives as needed, and to secure such shots and boosters as recommended by the BUYERS’ veterinarian.
The BUYERS agrees that, if for any reason they must dispose of the dog, the dog will be returned to the BREEDER who will relocate the dog in a suitable home. The BUYERS will, in no circumstance, place the dog into another home without the consent of the BREEDER. If the dog is returned in good health, in good condition, obedient, housebroken and socialized, the BREEDER will refund the following amounts to the BUYERS. Said refund shall be paid after the BUYERS has executed all documents required to transfer ownership of the dog to the BREEDER:
1.From seven days after the time of sale up to one year of age – 75% of purchase price
2.From one year of age up to two years of age – 50% of purchase price
3.From two years of age up to four years of age – 25% of purchase price
4.From four years of age on, the dog must be returned to BREEDER for no monetary refund.
BREEDER will deduct the cost of any required veterinary care from the refund.
It is agreed that upon the death (at any age) of the above described Border Terrier prompt notice of any particulars of death shall be given to the BREEDER.
This agreement constitutes the entire understanding of the parties and may only be modified or amended by a written document signed by the party to be charged. This agreement is binding upon the BUYERS, BREEDER and their heir’s agents and assigns. In the event that any one, or more, of the provisions (or applications thereof) contained in this Agreement shall be invalid, illegal or unenforceable in any respect, the validity, legality or enforceability of the remaining provisions of the Agreement, or any application thereof, shall not in any way be affected or impaired; provided however, that the extent permitted by applicable law, any invalid, illegal or unenforceable provisions may be considered for the purpose of determining in the event of the parties in connection with the other provisions of this Agreement.
Failure to adhere to these agreements will result in the repossession of the dog by the BREEDER, who will seek punitive damages to their reputation as a BREEDER.
This Agreement is made for the mutual benefit and protection of BUYERS and BREEDER for the protection of the named dog, and for the protection and preservation of the Border Terrier breed.
This Agreement shall be construed and applied according to the laws of the State of Washington.
