The new owner contract shown is a sample posted by this member as a representative of the agreement you would enter into prior to obtaining a puppy/dog from this breeder. It is not, nor does it imply, a contract with or guarantee by QualityDogs.com, endorsement by QualityDogs.com of this contract, or any responsibility, express or implied, by QualityDogs.com. The breeder listed is solely responsible for the content of this contract and its satisfaction. For your protection, QualityDogs.com recommends obtaining a printed, signed copy of any contract.

Puppy Purchase & Sales Agreement

The parties enter into this contract for the purchase and sale of one (1) _______________ puppy. The contract terms set forth are prepared for the benefit of each individual dog, breeder, and buyer. Without regard to the breed of dog, there is always a risk of physical problems even in the most selective breeding practices.

This [sex]___________ [breed]_______________ puppy was born on ________________, 200__ to sire ____________________________ (AKC # _________________________) and dam ____________________________ (AKC # _________________________) and can be described as [color] ___________________________________ born on ___________ day of _________________, 200___.

The puppy has been reserved with a non-refundable deposit that counts toward the total price of the puppy. Position in the reservation order is determined by order of deposit received. All deposits are fully transferable to future litters (wherein the reservation order may change), currently available puppies, or other canines although the price for each of these canines may not necessarily be the price for the original puppy.
This agreement, made this ___________ day of _________________, 200___ is between TEXAS Paws and Tails (heretofore referred to as TPAT), located at ___________________________________________________ and the BUYER residing at ___________________________________________.
Every precaution has been taken to see that your new pet is Healthy and has had proper Socialization.

Important: PLEASE READ THIS ENTIRE AGREEMENT.

TPAT does not make a guarantee as to the disposition, confirmation, size, color or breeding/show capability of puppy purchased. There are certain disorders that may be caused by environmental factors; therefore, this health guarantee does not include hypoglycemia, worms, parasites, kennel cough, coccidian, immunity level, mites, pneumonia, mange, heatstroke, ringworm, conjunctivitis, fleas, ticks, ear infections, allergies, thyroid dysfunction, and any other common occurrences found in puppies that can be treated. Precautions are taken to avoid these conditions. Worm your puppy regularly with wormer from your vet. Keep your puppy's play area and bedding clean at all times. Hypoglycemia is a serious matter for a young small puppy. For hypoglycemia provide your puppy with frequent small meals and water all through the day.

TPAT is not and cannot be responsible for undesirable traits the dog accrues once it is transferred to the Buyer(s). The dog is warrantied only for the purpose of being a companion animal. While it may be capable of performing other functions, no warranty is given as to its fitness for any special purpose.

If at any time, there is demonstrable neglect, abuse or illegal activity involving this canine, the said canine is subject to immediate forfeiture to TPAT.

In the event of breach of this agreement, the Buyer(s) agrees to pay all expenses of retaking, holding, preparing for sale, selling, and expenses as may be allowed by law and incurred by the seller in enforcing his/her rights under this security agreement. The dog may be subject to forfeit if the Buyer(s) does not fulfill his/her obligations.

Spay/Neuter: Although this is recommended, TPAT cannot be liable for any complications occurred from this elective surgery.

Your new puppy has been eating CANIDAE® All Life Stage (dry formula). Please continue to feed this to avoid diarrhea. Although we highly recommend this high quality food, if you chose to change your pet’s diet, please do this gradually by mixing the two 50/50, gradually fazing out one. If your puppy doesn't eat, vomits or has diarrhea or appears to be weak within the first 24-48 hours of being in its new home, please notify your vet IMMEDIATELY- Please DON’T WAIT. Puppies can dehydrate very rapidly and your puppy’s life may depend on your quick response.

While this puppy is small, make sure he/she has food and water three (3) times a day. If not eating, try mixing can food or chicken style baby food with the dry. Water should be offered more often, ESPECIALLY in the warm months of the year. Remember, he/she is small and can dehydrate very fast. Above all, allow your puppy lots of time to rest. Don't over exert your new puppy.

If you vaccinate your puppy outside of the schedule you have been advised, this health guarantee is VOID. Regardless of what your vet recommends, over-vaccination can cause death! TPAT assures you that we care about our puppies and really do give them the protection they need to go out into the world!! Vaccines should be no less than two (20 weeks apart! Not completing your puppy's vaccinations is cause for this health guarantee to be VOID! Being a responsible pet owner means vaccinating your puppy.
As the Seller, TPAT agrees to the following:
A. TPAT will provide Buyer(s) with a registration application ("puppy papers") to register the puppy with the American Kennel Club at the time of purchase. In the rare instance that the puppy papers are not available at the time of purchase, Seller will provide Buyer(s) with complete documentation to indicate that the litter registration application is being processed by the registering club. The registration papers will be mailed to Buyer(s) as soon as they're received.
B. TPAT will provide a vaccination record and veterinary examination record of the purchased puppy/dog. Please provide this information on your first vet visit. Please be prepared to follow your vet’s advice on scheduled vaccines, wormings & heart worm preventative. If the puppy/dog is due for vaccinations, and the Buyer(s) fails to provide vaccinations on that day, this guarantee is null and void if the puppy contracts diseases that would otherwise be prevented by those vaccinations.
C. TPAT may cancel the sale prior to Buyer(s) taking possession of the puppy in the event that Buyer(s) listed false or misleading information. In this situation, Buyer(s) should not expect to receive a deposit refund.
D. TPAT guarantees the above-described puppy to be healthy at the time of the sale. TPAT does not assume any liability for any injury to said puppy after time of sale and in the hands of the Buyer(s). If there is a problem with the puppy, TPAT’s veterinarian and Buyer(s) veterinarian must agree that health reasons existed before time of purchase, provided the puppy has been properly cared for in Buyer(s) possession.

This contract contains the entire agreement between the parties and no statement or verbal agreements made by either party that are not contained in this written contract shall be valid or binding. This contract may not be modified or altered except in writing and signed by both parties. Violations of this Contract will constitute BREACH of CONTRACT, prosecutable by law, and may result in mandatory confiscation and return of the puppy to the Seller.

A copy of this completed Contract with both Buyer and Seller's signatures will be provided to the Buyer.
Note: Contract not binding until signed by both Buyer and Seller. Upon signature completion, this contract will become a legal and binding document, as agreed by Buyer and Seller.

ADDENDUM

Breeding Rights

TEXAS Paws and Tails agrees to one of the following breeding rights and responsibilities for this canine by initialing the relevant type of breeding rights below.

A. Full breeding rights. Transfer of all breeding rights to the Buyer(s). Buyer(s) agrees to not breed the dog before it is physically and psychologically mature and never outside of the breed. The Buyer agrees to not breed the female before she is two years old and no more than four times in her lifetime. All breedings must be approved and litter information shall be submitted to TEXAS Paws and Tails for our records.

B. No breeding rights. At no time shall the Buyer use this canine for breeding at any time. TEXAS Paws and Tails shall remain the owner on registration paperwork to prevent this. The Buyer is encouraged to spay or neuter this animal.
