TERMS OF CONTRACT
1. The prefix “Destiny” is required in registering the above said dog with the AKC. Not using this prefix will render all guarantees provided in this contract null and void. The breeder may choose to use a “theme” for the naming of any or all puppies from this litter. The Breeder will notify buyer if a “theme” is to be used for the naming of the said puppy.
2. The above said dog is to be kept as a house pet only. Extensive unsupervised time in outside areas, garage, or tied up outside is not allowed, unless adequate shelter, food and water is provided. A good premium pet food must be provided, or a lesser quality may be given but the lacking nutritional needs for the animal must be supplemented.
3. The above said puppy/dog and offspring will not be used as an attack dog or a guard dog for people, animals, or property.
4. It is highly recommended that all puppies have professional training and proper socialization.
5. If the above said puppy is being sold on full registration: has the right to reproduce or show puppy as long as the buyer uses their best judgment when choosing prospects for breeding or showing. The breeder cannot guarantee that the above said puppy will be “breeding or show” potential at the time of maturity due to circumstances beyond breeder's control.
6. Breeding bitches may not be bred before 18 months of age. We recommend that all breeding/showing stock be hip and elbow certified by the OFA or UPENN. Females must not produce more than 2 litters in one year and then must have a year off. Females must not be bred after 6 years of age. Puppies that would not “better the breed” must be sold on spay/neuter contract.
7. Full registration puppies may only be bred to AKC registered English Mastiffs never to another breed of dog. No puppies may be sold to animal collectors, over populated breeders, backyard breeders, puppy mills, or pet stores.
8. The buyer shall provide the dog with necessary veterinary care upon sickness, disease, or injury and shall take it to a veterinarian at least once a year for an annual health exam and routine vaccinations.
9. The buyer shall provide the animal with humane care and maintain it in accordance with all current and future state, county, and municipal laws and ordinances where the buyer resides or will reside.
10. If the above said puppy/dog cannot be kept by the buyer, the buyer shall notify the breeder/seller immediately. The above said puppy/dog may not be sold or given away to anyone without written permission from the breeder. In the event the buyer has found a suitable home for the mentioned dog the buyer must have written permission from the breeder to place the dog. If the above stated dog cannot be re-homed, it must be relinquished to the breeder at buyer’s expense and AKC papers transferred within 2 weeks.
10A.The breeder has no desire to repossess any dog that they have placed. The intent of the paragraph pertaining to re-homing is to protect the above said dog and to prevent adverse situations.
11. Puppies/Dog having limited registration as a pet quality puppy, buyer agrees that the above stated puppy/dog is not to be bred under ANY circumstance. In addition, neutering or spaying will be performed by the age of 20 months. Once this is done, copy must be provided to the breeder no later than 30 days after the procedure.
12. This contract is non-transferable and only applies to the parties stated and signed above. Failure to comply with any parts of this contract will render the buyer liable to the breeder for the cost thereof, including attorney fees and related expenses, plus the sum of $5000.00 (Five Thousand Dollars US) in damages, such as damages to the breeders kennel name and reputation, time, trouble and mental duress.
13. The buyer and breeder both agree that jurisdiction for any legal proceedings that arise from the result of this contract will be held in Jackson County Indiana.
14.AKC registration papers will be supplied to the buyer at the time of sale(if available) or forwarded to the buyer once the breeder has received them from AKC; or after the buyer fulfills any applicable terms and/or special provisions that apply to this transaction.
15. HEALTH AND HEALTH GUARANTEE

All precautions have been made to insure that this puppy is in excellent health at the time of purchase including vaccinations at 8 weeks of age and has been dewormed on a regular basis. The breeders’ veterinarian has made a final health check and a current health certificate is included in your new puppy packet. It is recommended that additional vaccinations be given at 12 and 16 weeks of age, with annual booster immunizations. Additionally, male show dogs have been checked and verification has been made that both testicles have descended at the time of pickup. _____________ (Initial) Accidents can happen with new puppy dogs, and this contract does not cover testicle trauma after the puppy goes to his new home.

The Breeder warrants the puppy to be in excellent health and free from parasites at the time of purchase/pickup, but has not made and does not now make any further warranties as to the puppy’s condition after pickup. It is the Buyers responsibility to prevent illness and injury by providing necessary booster vaccinations, veterinary care, proper nutrition, fresh water, shelter, training and supervision. The breeder has made every effort to breed healthy dogs and has raised this puppy to the best of her ability.
Breeder does not warrant against parvo, distemper, intestinal parasites, pyrometera or any reproductive issues.

It is recommended by the Breeder that the Buyer take the puppy to a Veterinarian of his/her choice and gives three days from the date of delivery of the puppy in which to do so. If, within those three days, a veterinarian finds the puppy to be unsound, unhealthy, or possessing a serious genetic defect, a statement in writing must be provided to the Breeder by that veterinarian documenting said condition for Breeders’ veterinarian to review. Upon confirmation from Breeders’ vet of said condition, Buyer may return the puppy, registration and all of his/her effects to the Breeder and receive a full, immediate refund of the purchase price. All transportation costs involved are the responsibility of the Buyer.

This puppy is guaranteed not to develop PRA or pass on the gene for PRA as both of the parents are negative for the gene via parentage or by testing.

This puppy is guaranteed to pass OFA hip certification (Mild Subluxation is not considered a failing hip score) exceptions as noted) through the age of 24 months (2 years). If a puppy is thought to have a genetic defect, hip X-rays must be taken per OFA or UPENN recommendations and submitted to the appropriate facility. Copies of findings must be submitted to the seller/breeder. Defects must be proven to be genetic and not caused by environmental factors or mishandling by the buyer. Should findings be determined genetic, seller/breeder will offer a full refund or replacement puppy of equal or greater value. Seller/breeder holds the right to make a replacement or refund up to 6 months from the time of proven health issue.

No replacement puppy or refund will be given if dog is spayed/neutered or bred prior to OFA hip certification.
After above said puppy/dog leaves the breeder’s property, no financial obligation is due from the breeder.
