It is no longer reasonable to do business on a handshake. My contract is very specific and legally enforceable.
Special provisions and conditions will be negotiated for collies intended for show and breeding careers. Additional consideratons will be available for junior handlers.
Companion/Pet collie contract contrains the following clauses:
No collie placed on a spay/neuter contract may be bred without the express written permission of the Seller. Any unauthorized breeding constitutes an immediate breach of contract and the Buyer forfeits any and all rights to the ownership of this collie and agrees to return it to the Buyer plus cover the cost of any and all legal fees to recover the above-described collie.
The Seller takes great pride in Halcyon Days collies and wants to know of any problems the Buyer has with this collie at any time. The Seller will always take back any collie obtained from the Seller at any time, for any reason, however the voluntary return of this collie after the initial 14 day General Health Guarantee will not automatically entitle the Buyer to a refund of the purchase price. The option to refund the purchase price, or any part there of, shall be maintain by the Seller.
The seller must be informed before the collie is transferred to a third party. The Buyer understands that this collie is not to be sold, surrendered, given, willed, or left with any research facility, laboratory or University for use in animal experimentation; or to an animal broker, humane shelter, SPCA, collie rescue, or any other organization dealing in the rehoming trade, sales or auctioning of animals, or to any individual active in dog fighting or animal sacrifice. This contract is to be transferred with the collie and shall remain in effect in its original form for all subsequent transfers of ownership. In the event that the Buyer has already located a suitable third party interested obtaining the ownership in this collie, the Seller agrees to allow placement of this collie with that third party after screening the home for suitability under the terms of the original agreement.
