SELLERS REPRESENTATIONS
The following representations and conditions apply to the sale of the aforementioned dog:
1. As of the date of this agreement, the dog is in good health and free of communicable diseases.
2. The buyer has two (2) weeks to have dog examined by a veterinarian and to personally inspect the dog. Any claims must be made within this period and will be verified by Seller’s own veterinarian. Congenital defects are guaranteed until one year old unless stated below. Seller is not responsible for any accidents or injuries, physical or internal after the puppy/dog leaves the seller’s care.
3. The Buyer agrees upon purchase of the puppy that the dog may be registered with the name D’VINE or BEAUVOL followed by a name of the Buyers determination.
STIPULATIONS
Pet Quality:
a. This dog has been graded to be PET quality as determined by the Seller: Is defined as a puppy/dog that has a disqualifying fault or other shortcoming that precludes showing and or breeding. Said fault will not prevent the puppy/dog from living an otherwise normal and healthy life.
b. All dogs sold as Pet Quality will be spayed or neutered at appropriate time for dog, but within one year of purchase at the buyer’s expense. If this provision is not met, the owner will be considered in breach of contract and legal actions may be taken.
c. AKC registration form for the dog will be provided to the new owner upon evidence that the dog has been spayed or neutered. Buyer acknowledges AKC may charge more or refuse registration of a dog over one year of age.
d. The new owner agrees that this animal will be not be bred, sold, leased or given away to any such person who supports any activity detrimental to the image, welfare, or humane treatment of dogs. This includes raffles, giveaway prizes, puppy brokers, pet shops, puppy mills, litter lot sales or the use of animals in research experiments.
MAINTENANCE:
1. Buyer agrees to maintain this dog in good health, provide routine preventative health care including, but not limited to, inoculation, internal and external parasites, and where indicated Heartworm preventative medication.
2. Buyer further agrees to provide proper exercise as indicated in order to maintain this dog or bitch in proper weight and physical shape. A proper diet consists of high quality dog food and supplements. Foods NOT to be fed include highly commercialized brands with artificial preservatives.
3. Buyer agrees that this dog or bitch is NOT to be LEFT IN A BACKYARD OR KENNEL ONLY. This dog or bitch is sold with the understanding that it is to go to carefully selected parties and that the Buyer AVOWED the dog or bitch would become a member of the family. (This is to assure proper development and maintenance of the temperament of which the animal is bred).
4. Buyer agrees Seller will REPOSSESS DOG OR BITCH UPON EVIDENCE OF NEGLECT AND/OR ABUSE at no expense to the Seller
5. If at any time buyer should decide to give the dog up, the seller will accept it back and attempt to find a suitable home. Shipping and related expenses in placing the dog or puppy are the responsibility of the buyer and buyer agrees to assume responsibility for such expenses. However, if the seller is able to sell the dog, buyer will receive the profit from that transaction. Buyer must understand older dogs are not easy to sell and it may be necessary to find a free adoptive home.
6. Buyer understands that Seller is available to answer questions regarding care, feeding, and training of dog at Sellers home phone number anytime they are needed.
