Contracts vary depending on show, companion, male female, etc. Below is a sample of our companion female contract.
1. SELLER
Guarantees that dog is in good health and free of communicable diseases at the time of sale. If within 72 hours from the time Buyer takes possession of dog, the dog purchased is found by a licensed Veterinarian not to be in good health, then Seller agrees to refund the purchase price upon return of dog to Seller. Any costs incurred, to return dog is Buyers responsibility. Or Buyer agrees to return the dog to the Sellers Veterinarian and Seller agrees to incur any expense during this period. Buyer shall assume full responsibility for the health, anatomical make-up, appearance and temperament of the above described animal during said 72 hour period. If the condition of the animal has changed in any of the categories mentioned in the previous sentence, the Seller is relieved of obligation to return the full amount of the purchase price, otherwise the full purchase price will be refunded. Any claim of change in the animal by the Buyer must be communicated to the Seller within 72 hours. In order to receive an adjustment, under the terms of this Sales Contract, Buyer must return signed A.K.C. papers to Seller before any adjustment hereunder. Buyer must make animal available to Seller or designee for appropriate examination.
2. BUYER
Understands if COMPANION that dog is sold with a limited registration, meaning that if bred, any offspring cannot be registered. Also dog cannot be shown in conformation shows, however dog can compete in performance events, such as obedience, agility, etc. Seller reserves the right to revert the registration to full at a later date, providing all proper health testing is done, such as OFA.
3. BUYER
Agrees to have dog spayed or neutered if sold as a COMPANION. This should be done before dog is 1 year of age, but not before 6 months to allow for proper development.
4. BUYER
Agrees to take good care of the dog and to provide adequate food, housing, and medical care. This includes Heartworm
Preventative and monthly flea control such as Frontline or Advantage. Obedience classes are recommended along with proper socialization opportunities for the puppy/dog.
5. BUYER
Agrees not to keep dog on a chain or similarly tethered while unattended. If dog is discovered as previously described or found to be mistreated in any fashion, Seller has the right to confiscate dog and place in a proper home. Buyer has no monetary recourse.
6. BUYER
Buyer understands that certain health issues can arise from not grooming on a regular basis and agrees to have this dog professionally groomed every 4-6 weeks.
7. BUYER
Agrees to follow Seller’s recommendations regarding feeding, training, exercise, and general care.
8. BUYER
Agrees to return said dog to Seller if it becomes necessary for any reason for Buyer to relinquish ownership of dog purchased. Any monetary remuneration is left solely to the discretion of the Seller.
9. BUYER
Agrees that they are purchasing this dog for their personal use, and will not broker or transfer ownership or care of this dog to any other person or organization. Buyer forfeits ownership of this dog if this is not strictly adhered to.
10. BUYER
Agrees to keep the Seller informed about the dog especially pertaining to health, growth, development and temperament. And to try to write, e-mail or call at least on the 6th, 18th, and 24th months from whelping date. If any unusual problems develop Seller shall be contacted at once, especially if they are medical in nature.
11. BUYER
Agrees to allow Seller or a similar representative to visit Buyers home and the purchased dog shortly after sale.
12. BOTH PARTIES
Enter this agreement with sincere intentions for the preservation of quality Poodles and a mutual desire for the best interest of the breed.
13.This writing constitutes the full agreement of the parties. Any interpretations and disputes arising from this contract as to its
terms and conditions will be determined and resolved under the laws of the State of Florida, Lee County.
14. In the event that a disagreement or enforcement of this agreement is necessary, it shall be placed before an arbitrator or party of arbitrators, such as the American Arbitration Association or other arbitration associations as set up and agreed between the parties. Upon a decision, the parties agree to be bound by the decision of that arbitration, and the prevailing party shall be entitled to reasonable costs including but not limited to attorney fees necessary to enforce the agreement.
